申訴人mm公司和被訴人vv有限公司之間的爭議的原因在于被訴人沒有履行于1992年5月14日締結(jié)的由其提供8,000公噸鋁錠的470e和471e號合同義務(wù)。

根據(jù)上述兩個合同規(guī)定，8,000公噸鋁錠本應(yīng)在1992年7月至12月期內(nèi)從歐洲數(shù)個港口全部發(fā)出，月裝貨量按合同具體規(guī)定執(zhí)行。本公司，即申訴人，于1992年6月7日通過中國銀行倫敦分行開出了e25520和e25733兩張信用證。

according to the stipulations of the said contracts, 8000 metric tons of aluminum ingots should have been completely delivered from european ports during a period from july to december, 1992, and each month a quantity specified thereby should have been shipped. this corporation, the plaintiff, issued letters of credit e25520 and e25733 on the 7th of june, 1992 through the bank of china, london.

鑒于上述兩個合同分別規(guī)定將漢堡、鹿特丹和安特衛(wèi)普及漢堡和鹿特丹作為各自的發(fā)貨港，故申訴人曾多次發(fā)電傳給被訴人，要求其將發(fā)貨港的具體名稱及準(zhǔn)備發(fā)貨的時間告知申訴人，以便本公司派船。然而，被訴人對申訴人的電傳卻采取躲避態(tài)度，一直不予答復(fù)。

上述兩個合同規(guī)定的8,000公噸鋁錠的總價差為784,000英鎊(即561,000英鎊加187,000英鎊)。
