2.PartyAshallconductdirection,supervisionandevaluationofPartyB’swork.

3.PartyAshallprovidePartyBwithnecessaryworkingandlivingconditions.4.PartyAshallprovideco-workersforthefirstweekifnecessary.

VI.PartyB’sobligations

1.PartyBshallobservethelaws,decreesandrelevantregulationsenactedbytheChinesegovernmentandshallnotinterfereinChina’sinternalpoliticsaffairs.

2.PartyBshallobservePartyA’sworksystemandregulationsconcerningadministrationofforeignteachersandshallacceptPartyA’sagreement,direction,supervisionandevaluationinregardtohis/herwork.WithoutPartyA’sconsent,PartyBshallnotrenderserviceelsewhereorholdconcurrentlyanypostunrelatedtotheworkagreedonwithPartyA.

3.PartyBshallcompletethetasksagreedonscheduleandguaranteethequalityofwork.

4.PartyBshallrespectChina’sreligiouspolicy,andshallnotconductreligiousactivitiesincompatiblewiththestatusofateacher.

5.PartyBshallrespecttheChinesepeoples’moralstandardsandcustoms.

V.Revision,CancellationandTerminationoftheContract

1.BothPartiesshouldabidebythecontractandshouldrefrainfromrevising,canceling,orterminatingthecontractwithoutmutualconsent.

2.Thecontractcanberevised,cancelled,orterminatedwithmutualconsent.Beforebothpartieshavereachedanagreement,thecontractshouldbestrictlyobserved.

3.PartyAhastherighttocancelthecontractwithwrittennoticetoPartyBunderthefollowingconditions.

(1)PartyBdoesnotfulfillthecontractordoesnotfulfillthecontractobligationsaccordingtothetermsstipulated,andhasfailedtoamendafterPartyAhaspointeditout.

(2)Accordingtothedoctors’diagnosis,PartyBcannotresumenormalworkafter30dayssickleave.

4.PartyBhastherighttocancelthecontractwithawrittennoticetopartyAunderthefollowingconditions:

(1)PartyAhasnotprovidedPartyBwithnecessaryworkingandlivingconditionsasstipulatedinthecontract.

(2)PartyAhasnotpaidPartyBasscheduled.

VIII.BreachPenalty

Wheneitherofthetwopartiesfailstofulfilthecontractorfailstofulfillthecontractobligationsaccordingtothetermsstipulated,thatis,breaksthecontract;itmustpayabreachpenaltyofUS$500(ortheequivalentinRMB).IfPartyBaskstocancelthecontractduetoeventsbeyondcontrol,itshouldproducecertificationbythedepartmentconcerned,obtainPartyA’sconsent,andpayitsownreturnexpenses;IfPartyBcancelsthecontractwithoutvalidreason,itshouldpayitsownreturnexpensesandpaybreachpenaltytoPartyA.

IfPartyAaskstocancelthecontractduetoeventsbeyondcontrol,withtheconsentofPartyB,itshouldpayPartyB’sreturnexpen

聘請雙方本著友好合作精神，自愿簽訂本合同并保證認真履行合同中約定的各項義務。

一、合同期自起至止。（法定節(jié)假日及寒暑假除外）

二、甲乙雙方合作內(nèi)容：Cooperationcontents:

甲方聘請乙方為教師進行英文授課。

EmployeeemployedbyengagerasateachertoteachEnglish.三、乙方工作時間TheworktimeofpartB1、根據(jù)學校的作息時間表，一般每周工作日為5天（節(jié)假日除外），如遇節(jié)假日學校調(diào)換課程時間則按學校要求安排授課。

Accordingtoschool’steachingschedule,teacherusuallywork5dayseachweek(exceptholidays).Iftheschoolchangethetimeinholidays,teachershouldteachaccordingtoschool’sarrangement.

2、遇甲方在合作學校有特殊活動時，乙方應該參加，如慶祝日、教研活動及一些重要的英語活動等，甲方對此給予乙方一定的交通補助，但不再支付其他費用。

IfpartAhavesomespecialactivitiesincooperationschool,partBshouldattend,forexample,celebrationday,teachingresearchactivitiesandsomeimportantenglishactivities,partAwillgivepartBsometransportfeeforthese,butnoextrapayment.

五、授課地點Teachingaddress

甲方根據(jù)乙方的實際情況，為乙方安排的課程在主城區(qū)內(nèi)，如有其他變化，雙方協(xié)商解決。

六、課時安排Classarrangement一般每周課時為課時親自面授學生課（一課時的時間長短合作單位的課程表為準）。遇特殊情況，如學校課程調(diào)整等情況雙方協(xié)商解決。

七、薪酬標準Salarycriterion

1、雙方協(xié)商達成一致，按課時費的方式計算工資Thetwopartiesagreewitheachother。

2、雙方協(xié)商達成一致，甲方不負責乙方寒、暑假的工作和生活，即甲方不支付工資給乙方，乙方可自行安排假期生活。但是甲方若為乙方安排了課程，乙方應首先滿足甲方的要求，甲方按實際課時付費給乙方。

3、雙方合作期間，甲方為乙方提供住房一套，乙方使用房屋所產(chǎn)生的費用由乙方自行負責，甲方每月第一周將當月房屋租賃費以現(xiàn)金方式支付給乙方。雙方合作結(jié)束，甲方不再為乙方提供住房。八、其他事項Otherthings

1、乙方在合作期間的健康及醫(yī)療由乙方自行解決。

（1）如果乙方因患病并經(jīng)醫(yī)院證明確不能工作，可以向甲方提出請假，乙方在病假期間無工資。如果乙方連續(xù)7天請病假，甲方可以按照國家外專局合同有關(guān)規(guī)定中止與受聘方的合同。

IfpartBwassickandhavecertificatefromhospitaltocannotwork,partBcanapplyleave,butnosalaryintheseperiod.IfpartBapplyleave7dayscontinuous,partAcanterminatethecontractaccordingtothecontractissuedbystateadministrationofforeignexpertsaffairs.（2）如果乙方在工作時間內(nèi)需請事假，須得到甲方的批準；如果乙方未向甲方提出請假，而曠工不上課，甲方有權(quán)在其曠工期間按雙倍罰扣其工資

IfpartBapplyleaveinworktime,itmustbeconfirmedbypartA.IfpartBabsentfromclassandnoapplyleave,partAhaverighttodiscountthedoublesalary.

以上情況給合作學校造成損失的，乙方應積極給予彌補。Ifallsituationabovemakelosstothecooperationschool,partBshouldmakeupactive.九、機密secret

1、未經(jīng)允許，雙方均不可將工資數(shù)額及合同內(nèi)容透露給第三方。Thetwopartiescannottellothersaboutsalaryandcontracts.2、未經(jīng)甲方允許，乙方不可將授課學校情況透露給第三方。PartBcannottellothersaboutschoolsituation.

由此造成的損失，由造成損失方自行負責，另一方保留追加法律責任的權(quán)利。

Thelosswhoworkedhaveresponsibilityfortheloss,andotheroneretaintherighttosuperaddthelawliability.

十、合同的變更、解除和終止Contractchange,reliefandtermination

本合同自雙方開始合作之日起生效，合同期滿即自行終止。如一方需要解除合同，需提前20天通知另一方，否則視為違約。合同期滿后，甲、乙雙方聘用關(guān)系解除，乙方在華的一切事務自理。

Thiscontractwilltakeeffectbeginthetwopartiescooperationandterminatewhencontractexpired.Ifonepartwanttorelieve,shouldtellotherpartbefor20days,otherwise,itmeansbreachofcontract.Whencontractexpired,twopartieshavenoemployrelationship.

十一、本合同于年月日在（地點）簽訂，一式兩份，每份都有用中文和英文寫成，兩種文本同等作準。
