外教聘請合同Contract

聘方姓名（以下稱甲方）：Engager(partA)：

受聘方姓名（以下稱乙方）：Employee(partB)：

聘請雙方本著友好合作精神，自愿簽訂本合同并保證認真履行合同中約定的各項義務(wù)。

Thetwoparties,inaspiritoffriendlycooperation,agreetosignthiscontractandpledgetofufilconscientiouslyalltheobligationsstipulatedinit.

一、合同期自起至止。（法定節(jié)假日及寒暑假除外）

二、甲乙雙方合作內(nèi)容：Cooperationcontents:

甲方聘請乙方為教師進行英文授課。

EmployeeemployedbyengagerasateachertoteachEnglish.三、乙方工作時間TheworktimeofpartB1、根據(jù)學(xué)校的作息時間表，一般每周工作日為5天（節(jié)假日除外），如遇節(jié)假日學(xué)校調(diào)換課程時間則按學(xué)校要求安排授課。

Accordingtoschool’steachingschedule,teacherusuallywork5dayseachweek(exceptholidays).Iftheschoolchangethetimeinholidays,teachershouldteachaccordingtoschool’sarrangement.

2、遇甲方在合作學(xué)校有特殊活動時，乙方應(yīng)該參加，如慶祝日、教研活動及一些重要的英語活動等，甲方對此給予乙方一定的交通補助，但不再支付其他費用。

IfpartAhavesomespecialactivitiesincooperationschool,partBshouldattend,forexample,celebrationday,teachingresearchactivitiesandsomeimportantenglishactivities,partAwillgivepartBsometransportfeeforthese,butnoextrapayment.

五、授課地點Teachingaddress

甲方根據(jù)乙方的實際情況，為乙方安排的課程在主城區(qū)內(nèi)，如有其他變化，雙方協(xié)商解決。

AccordingtopracticalsituationofpartB,partAwillarrangethecourseforpartBinMainTown.Ifhavesomechange,thetwopartiesshoulddiscusstosolve.

六、課時安排Classarrangement一般每周課時為課時親自面授學(xué)生課（一課時的時間長短合作單位的課程表為準）。遇特殊情況，如學(xué)校課程調(diào)整等情況雙方協(xié)商解決。

七、薪酬標準Salarycriterion

1、雙方協(xié)商達成一致，按課時費的方式計算工資Thetwopartiesagreewitheachother。

2、雙方協(xié)商達成一致，甲方不負責(zé)乙方寒、暑假的工作和生活，即甲方不支付工資給乙方，乙方可自行安排假期生活。但是甲方若為乙方安排了課程，乙方應(yīng)首先滿足甲方的要求，甲方按實際課時付費給乙方。

3、雙方合作期間，甲方為乙方提供住房一套，乙方使用房屋所產(chǎn)生的費用由乙方自行負責(zé)，甲方每月第一周將當月房屋租賃費以現(xiàn)金方式支付給乙方。雙方合作結(jié)束，甲方不再為乙方提供住房。八、其他事項Otherthings

1、乙方在合作期間的健康及醫(yī)療由乙方自行解決。

Sickleaveandprivateaffairleave

（1）如果乙方因患病并經(jīng)醫(yī)院證明確不能工作，可以向甲方提出請假，乙方在病假期間無工資。如果乙方連續(xù)7天請病假，甲方可以按照國家外專局合同有關(guān)規(guī)定中止與受聘方的合同。

IfpartBwassickandhavecertificatefromhospitaltocannotwork,partBcanapplyleave,butnosalaryintheseperiod.IfpartBapplyleave7dayscontinuous,partAcanterminatethecontractaccordingtothecontractissuedbystateadministrationofforeignexpertsaffairs.（2）如果乙方在工作時間內(nèi)需請事假，須得到甲方的批準；如果乙方未向甲方提出請假，而曠工不上課，甲方有權(quán)在其曠工期間按雙倍罰扣其工資

IfpartBapplyleaveinworktime,itmustbeconfirmedbypartA.IfpartBabsentfromclassandnoapplyleave,partAhaverighttodiscountthedoublesalary.

以上情況給合作學(xué)校造成損失的，乙方應(yīng)積極給予彌補。Ifallsituationabovemakelosstothecooperationschool,partBshouldmakeupactive.九、機密secret

1、未經(jīng)允許，雙方均不可將工資數(shù)額及合同內(nèi)容透露給第三方。Thetwopartiescannottellothersaboutsalaryandcontracts.2、未經(jīng)甲方允許，乙方不可將授課學(xué)校情況透露給第三方。PartBcannottellothersaboutschoolsituation.

由此造成的損失，由造成損失方自行負責(zé)，另一方保留追加法律責(zé)任的權(quán)利。

Thelosswhoworkedhaveresponsibilityfortheloss,andotheroneretaintherighttosuperaddthelawliability.

十、合同的變更、解除和終止Contractchange,reliefandtermination

本合同自雙方開始合作之日起生效，合同期滿即自行終止。如一方需要解除合同，需提前20天通知另一方，否則視為違約。合同期滿后，甲、乙雙方聘用關(guān)系解除，乙方在華的一切事務(wù)自理。

I.PartyBwishestoengagetheserviceofPartyAGanzhouKingDoctorKindergartenofOxfordInternationalasaforeignEnglishteacher.Thetwoparties,inaspiritoffriendlycooperation,agreetosignthiscontractandpledgetofulfillconscientiouslyalltheobligationsstipulatedinit.

乙方自愿作為甲方外教在甲方從事教學(xué)服務(wù)工作。雙方在友好合作的基礎(chǔ)上簽訂本合同，并發(fā)誓遵守合同中所規(guī)定的各項條款。

II.Theperiodofservicewillbefromto.

乙方在甲方工作期間月工資為：￥6000元，以人民幣形式支付。

V.PartyA"sObligations

甲方義務(wù)：

1.PartyAshallintroducetoPartyBthelaws,decreesandrelevantregulationsenactedbytheChinesegovernment,thePartyA"worksystemandregulationsconcerningadministrationofforeignexperts.

甲方有義務(wù)向乙方介紹甲方所在當?shù)氐南嚓P(guān)法律、法規(guī)以及甲方工作機制、規(guī)程、規(guī)定以及與外國專家管理相關(guān)的規(guī)章制度。

2.PartyAshallconductdirection,supervisionandevaluationofPartyB"swork.甲方對乙方的工作負責(zé)指導(dǎo)、監(jiān)督以及評價。3.PartyAshallprovidePartyBwithnecessaryworkingandlivingconditions.

甲方必須向乙方提供乙方工作和生活必需的條件和設(shè)施。4.PartyAshallprovidePartyBwithanassistantforworkingandlivingaffairs.

甲方應(yīng)向乙方提供工作和生活聯(lián)系人5.PartyAshallpayPartyB"ssalaryregularlybythemonth.

甲方應(yīng)向乙方每月按期發(fā)放工資。VI.PartyB"sobligations

乙方義務(wù)：

1.PartyBshallobservethelaws,decreesandrelevantregulationsenactedbytheChinesegovernmentandshallnotinterfereinChina"sinternalaffairs.

乙方必須遵守中國的法律、法規(guī)和將關(guān)規(guī)定，不干涉中國內(nèi)政。2.PartyBshallobservePartyA"sworksystemandregulationsconcerningadministrationofforeignexpertsandshallacceptPartyA"sarrangement,direction,supervisionandevaluationinregardtohis/herwork.WithoutPartyA"sconsent,PartyBshallnotrenderserviceelsewhereorholdconcurrentlyanypostunrelatedtotheworkagreedonwithPartyA.

乙方必需遵守甲方的工作制度及與外國專家管理相關(guān)的規(guī)定，并接受甲方在工作方面的安排、指導(dǎo)、監(jiān)督和評價。未經(jīng)甲方批準，乙方不得從事任何兼職工作。3.PartyBshallcompletethetasksagreedonscheduleandguaranteethequalityofwork.

乙方必須按照計劃保質(zhì)保量完成甲方委派的工作。

4.PartyBshallrespectChina"sreligiouspolicy,andshallnotconductreligiousactivitiesincompatiblewiththestatusofanexpert.

乙方必須遵守中國的宗教政策，不允許從事與外籍專家身份不符的宗教活動。5.PartyBshallrespecttheChinesepeople"smoralstandardsandcustoms.

乙方必須尊重中國人民的道德規(guī)范和風(fēng)俗習(xí)慣。

6.IfPartyBhasanycontagiousorseriousdiseases,orifPartyBisfemaleinpregnancy,childbirthorbabynursingperiod,PartyBhasthedutytoinformPartyAbeforethecontractissignedsothatPartyAcanprovidespecialcaretoPartyB.Otherwise,PartyAwillnotbearanyrelatedresponsibilities.

乙方如有嚴重疾病或傳染性疾病、或者女性有懷孕、待產(chǎn)、哺乳等情況，必須在簽訂合同之前，向甲方如實聲明，否則造成后果由乙方承擔(dān)全部責(zé)任。

VII.Revision,CancellationandTerminationoftheContract

合同的修改、取消和終止：

1.Bothpartiesshouldabidebythecontractandshouldrefrainfromrevising,canceling,orterminatingthecontractwithoutmutualconsent(exceptthatmentionedinVI,6).

雙方必須嚴格遵守合同中所規(guī)定的內(nèi)容。不經(jīng)雙方同意，不得擅自單方修改、取消或者終止合同。但本合同第VI條第六款所規(guī)定的情況除外。

2.Thecontractcanberevised,canceled,orterminatedwithmutualconsent.Beforebothpartieshavereachedanagreement,thecontractshouldbestrictlyobserved.

在雙方同意的情況下，可以對合同進行修改、取消或者終止。但在此之前，必須嚴格遵守合同。

3.PartyAhastherighttocancelthecontractwithawrittennoticetoPartyBunderthefollowingconditions;

在以下情況下，甲方有權(quán)以書面形式通知乙方終止合同：

(1)PartyBdoesnotfulfillthecontractordoesnotfulfillthecontractobligationsaccordingtothetermsstipulated,andhasfailedtoamendafterPartyAhaspointeditout.乙方?jīng)]有完成合同中所規(guī)定的內(nèi)容，或者經(jīng)甲方提醒仍沒有履行合同中所規(guī)定的義務(wù)。

(2)Accordingtothedoctor"sdiagnosis,PartyBcannotresumenormalworkafteracontinued30daysickleave.

經(jīng)醫(yī)生診斷，乙方在連續(xù)30日病假后仍不能恢復(fù)正常工作。

4.PartyBhastherighttocancelthecontractwithawrittennoticetopartyAunderthefollowingconditions:

在以下情況下，乙方有權(quán)以書面形式通知甲方終止合同：

(1)PartyAhasnotprovidedPartyBwithnecessaryworkingandlivingconditionsasstipulatedinthecontract.

甲方?jīng)]有按照規(guī)定為乙方提供工作和生活所需條件和設(shè)備。(2)PartyAhasnotpaidPartyBasscheduled.甲方?jīng)]有按期向乙方發(fā)放勞務(wù)報酬。

VIII.BreachPenalty違約金

Wheneitherofthetwopartiesfailstofulfillthecontractorfailstofulfillthecontractobligationsaccordingtothetermsstipulated,thatis,breaksthecontract,itmustpayabreachpenaltyof￥50000RMB.任何一方不能按照合同中所規(guī)定內(nèi)容執(zhí)行，都將視為違約。違約方應(yīng)承擔(dān)￥50000元人民幣的違約金。

IfPartyBaskstocancelthecontractduetoeventsbeyondcontrol,itshouldproducecertificationsbythedepartmentconcerned,obtainPartyA"sconsent,andpayitsownreturnexpenses;IfPartyBcancelsthecontractwithoutvalidreason,itshouldpayitsownreturnexpensesandpaybreachpenaltytoPartyA.IfPartyAaskstocancelthecontractduetoeventsbeyondcontrol,withtheconsentofPartyB,itshouldpayPartyB"sreturnexpenses;ifPartyAcancelsthecontractwithoutvalidreason,itshouldpayPartyB"sreturnexpensesandpayabreachpenaltytoPartyB.如果因不可抗原因乙方請求終止合同，須出示有關(guān)部門開具的證明材料，經(jīng)甲方批準，自費返程路費。如果沒有正當理由乙方擅自終止合同，乙方應(yīng)自費返程路費，并承擔(dān)違約責(zé)任。如果甲方因不可抗原因結(jié)束合同，經(jīng)乙方同意后，應(yīng)由甲方負責(zé)提供乙方返程路費。如甲方?jīng)]有正當理由擅自終止合同，應(yīng)負責(zé)向乙方提供返程路費，并承擔(dān)違約責(zé)任。

IX.Theappendixofthiscontractisaninseparablepartofthecontractandhasequaleffect

本合同附件與合同正文具有同等法律效力。

X.Thiscontracttakeseffectonthedatesignedbybothpartiesandwillautomatically

expirewhenthecontractends.Ifeitherofthetwopartiesasksforanewcontract,itshouldforwarditsrequesttoanotherparty2weekspriortotheexpirationofthecontract,andsignthenewcontractwithmutualconsent.PartyBshallbearallexpensesincurredwhenstayingonafterthecontractexpires.本合同自簽訂之日起生效，到合同期滿自然終止。如其中任何一方有意延期，必須在合同期滿2周前向?qū)Ψ教岢�，在雙方同意下簽訂續(xù)約。合同期滿后，乙方負責(zé)之后的所有滯留費用。XI.

Arbitration仲裁

Thetwopartiesshallconsultwitheachotherandmediateanydisputeswhichmayariseaboutthecontract.Ifallattemptsfail,thetwopartiescanappealtothelocalcourt.有關(guān)合同內(nèi)容的含義，須雙方及時互相溝通，及時處理其中可能存在的爭議。如果經(jīng)雙方協(xié)商不能達成一致，可申請可向甲方所在地法院起訴。

STANDARDWORKCONTRACTFORFOREIGNTEACHERS

外籍教師工作合同附件

ⅠRequiredworkassignmentoftheemployedparty受雇方工作任務(wù)：

1.Preparelessonswellpriortoteaching上課之前充分備課；2.ConductEnglishlessons課堂授課；

3.Assessstudents"work對學(xué)生學(xué)習(xí)進行考核

4.Takeanactivepartinstudents"extra-curriculumactivitiesoftheemployingParty積極參與學(xué)生課外活動。

ⅡThesalarytreatment工資待遇1.Directpayment直接支付

MonetarysalaryRMB/month.Thesalarywillbepaidonthe20thofeachmonthfromthedayofstartingworktotheexpirationofthecontract.Incasethetimeisshorterthanawholemonth,thepaymentshallbecountedbyday.Thedailywageshallbe1/30ofthemonthlysalary(thesamewithFebruary).每月以人民幣形式支付工資。工資發(fā)放日期為合同簽訂后一直到合同期滿之間每月20日。如果遇到不滿一個月，按照天數(shù)計算工資，此時每日工資為月工資的1/30（二月份同）。

2.Indirectpayment.間接支付

1）Theemployingpartyagreestoprovidehousingconditionsandpayforthewaterandelectricity.雇用方提供住房條件和其水電費。

2）Theemployingpartyagreestopaytwiceforthedomestictravelingbonus.每學(xué)期兩次的國內(nèi)差旅交通費報銷。

3)Theemployingpartyagreestoaffordholidaysbonus.節(jié)假日補貼。

ⅢWorkTime,RestandHolidays

工作時間、休息和假期

1.Theworktimeoftheemployedpartyshallbe40hourseveryweek(two-dayweekend)Iftheworktimecannotreachtheabove-mentionedamount,PartyAcanarrangeforPartyBsomeotherconcernedworkoractivities,otherwise,theemployedpartyshouldbepaidashavingreachedit.受雇方每周工作量為40小時（周末雙休）。如果受雇方不能達到以上工作量，雇用方可根據(jù)需要安排受雇方其他工作作為補充。如果因雇用方原因致使受雇方不能達到要求所需工作量，則視為乙方已經(jīng)滿足工作量。

2.Iftheemployingpartyarrangesovertimeworkforthepartyemployed,itwillpaytheemployedpartyasalaryhigherthanthatnormalworktimeaccordingtolegalstandard.Theexactpaymentshouldbenegotiatedbetweenthetwoparties.如果雇用方安排受雇方從事工作量以外的工作，應(yīng)付給雇用方額外工資。額外數(shù)額由雙方協(xié)商。

3.TheemployedpartyisentitledtothefollowingpaidholidaysandfestivalsinChina:

NewYear"sDay,SpringFestival,MayDay,NationalDayandotherholidaysstipulatedbylawsandregulations.受雇方在中國享有以下假期和假日：元旦，春節(jié)，“五一”勞動節(jié)，國慶節(jié)以及法律、法規(guī)中所規(guī)定的其他節(jié)日。

ⅣSickleaveandprivateaffairsleave病假和個人事假

1.Certificatefromdoctorsforforeignersappointedbythehostinstitutionshouldbepresentedwhentheemployedpartyasksforsickleave.受雇方請病假應(yīng)持有雇用方指定的醫(yī)療機構(gòu)開具的醫(yī)療證明。

2.Privateaffairsleaveoftheemployedpartyshallbeapprovedbytheemployingparty.Theemployingpartywilldeductthesalarybyday.Inthecontractterm,theprivateaffairsleavesshouldnotexceed10days.Thecontinuousprivateaffairsleaveshallbenomorethan3days,andtwodays"salarywillbedeductedforeachdaythereafter.雇用方應(yīng)準許受雇方請個人事假。期間工資按照天數(shù)扣除。在合同期內(nèi)不超過10天。單次事假原則上不能超過3天，超過3天后每天扣除2天的工資。

3.Incaseofabsencefromworkwithouttheemployingparty’spermission,3days"salarywillbedeductedforeachdayabsent.Forseriouscircumstances,theemployingpartyhastherighttoterminatethecontractandinvestigatetheliabilityoftheemployedpartyforviolationofthecontract.不經(jīng)雇用方批準擅自離職，每曠工一天扣除3天的工資。在特殊情況下，雇用方有權(quán)對違反規(guī)則的受雇方終止合同并調(diào)查受雇方的可靠性。

ⅤConfirmationandchangeofeverytermoftheappendixofthestandardcontractmustbestipulatedinwrittenformthroughnegotiationbetweenthetwoparties.Anyoralagreementwillberegardedasinvalid.

本合同附件的確認和修改須經(jīng)過雙方協(xié)商后以書面形式寫明。任何口頭規(guī)定都視為無效。Thisappendixhasequalvalidityofthestandardcontractandcomprisesanintegralpartofthecontract.
